Reference is invited to instructions issued by the Department of Expenditure, Ministry of Finance from time-to-time regarding the procedure for booking of air tickets on Government account. As per existing procedure Government officials/offices can book the air tickets directly from Airlines (at Booking counters / Website of Airlines) and if needed, by utilizing the services of authorized agents. viz. M/s Balmer Lawrie & Company Limited (BLCL) and M/s Ashok Travels & Tours (ATT) [Department of Expenditure OM No.19024/1/2009-E.IV dated 16/09/2010 refers]. Air tickets for travel on LTC, to a limited extent, can also be get booked through Indian Railway Catering & Tourism Corporation(IRCTC) [Department of Personnel & Training OM No. 31011/6/2002-Estt.(A) dated 02/12/2009 refers].

1. When did the Right to Information Act, 2005 come into force?

The Right to Information Act came into force fully on the 12th October, 2005 (120th day of its enactment i.e., 15th June, 2005). Some provisions came into force with immediate effect viz. obligations of public authorities [Section 4(1)], designation of Public Information Officers and Assistant Public Information Officers [Sections 5(1) and  5(2)], constitution of Central Information Commission [Sections12 and 13], constitution of State Information Commission [Sections 15 and 16], non-applicability of the Act to Intelligence and Security Organizations [Section 24] and power to make rules to carry out the provisions of the Act [Sections 27 and 28].

2. Who is covered under the Right to Information Act, 2005?

The Act extends to the whole of India except the State of Jammu and Kashmir [Section 1].

3.Are "file notings' included in the definition of Information?

Section 2 (f) of the RTI Act defines 'information’ which includes ‘record'. Section 2(i)(a) states that a 'record' includes any document, manuscript and file. The operative definition of a 'file' is given in the Manual of Office Procedure prepared by the Central Secretariat, Government of India. The definition of 'file' in the Manual includes 'notes' and 'appendices to notes'.
In CIC Decision No. ICPB/A-1/CIC/2006 dt.31.01.2006, the CIC held that “file notings are not, as a matter of law, exempt from disclosure”. Thus, file notings can be disclosed under the Act.

Attention is invited to the Payment of Arrears of Pension (Nomination) Rules, 1983 which provide that after the death of the pensioner, all moneys payable to the pensioner on account of pension will be paid to the nominee of the deceased pensioner. In the absence of any nomination made by the pensioner, the arrears of his/her pension are paid to the legal heir as per the procedure indicated in para 4 of part A of annexure to Ministry of Finance OM No. 1(3)-E.V/83, dated 11.10.1983. However, dependants of some pensioners expressed difficulties in obtaining the legal heir-ship certificates and represented that the necessity of production of legal heir-ship certificates may be waived where the amount of arrears payable is small.

Cong-backed railway union threatens indefinite stir over pending demands

NEW DELHI: Congress-backed railway union has threatened a nation-wide indefinite strike in October if their long-pending demands relating to pay and perquisites are not met.

The strike call came from National Federation of Indian Railwaymen (NFIR), associated with Indian National Trade Union Congress (INTUC) after similar threat from other rail employees unions, including All-India Railwaymen Federation.

The strike would be in support of demands, including better pay packages for track men, cadre restructuring, and clearance of arrears and scrapping of the new pension scheme that the Federation has been making since last year.
"After discussion, it was decided to give four months time to the Government to announce appointment of 7th Pay Commission and settle pending issues through negotiated settlement, failing which the NFIR would take steps for launching indefinite strike on Indian Railways," the statement issued by NFIR said.

The State Human Rights Commission has directed the Director of Central Government Health Scheme (CGHS) to include one hospital in each district in the panel of the scheme to enable all the retired employees to get the benefits of the government’s health insurance scheme.

He also directed the Director and the Central Secretary to submit the report in this regard on August 7. The direction was following a complaint filed by Leela George, a retired central government employee.

There is only one hospital in the state empanelled in the health insurance scheme, which is in the capital city. There are only three consulting centres under the scheme which are also situated here. This makes it difficult for the pensioners residing in other districts to avail the benefits of the scheme.

According to the press release, the All-India CPI-IW for May, 2013 rose by 2 points and pegged at 228 two hundred and twenty eight) and expected Dearness Allowance due from July, 2013 is unchanged in respect of previous month expectation of 90% means 10% increase in present DA.  Now picture of expected DA, which is based on a standard calculation is confirmed now. An impossible increase of 9 points in AICPIN of June, 2013 will change the expectation from 90% to 91%.  See following table:-

The provisions regarding grant of gratuity and family pension to the members of families of the deceased Government servants/pensioners who were appointed on or before 31st December, 2003 and who are/were born on pensionable establishments are contained in Rules 50-54 of the Central Civil Services (Pension) Rules, 1972. The Central Administrative Tribunal, Madras Bench, has ruled that promotion cannot be withheld because of the mere pendency of investigation and directed the Defence Ministry to promote an Indian Ordnance Factories Service (IOFS) officer within 45 days.

Disposing of an application filed by M. Ravi, a 1975 batch officer, the Bench, comprising members B. Venkateswara Rao and Naresh Gupta, held that the defence authorities had erred in withholding his promotion without valid reason. The Bench also said, “No charge sheet has been issued to the applicant. The promotion was withheld merely on the ground of pendency of criminal investigation by the CBI.”

Mr. Ravi is presently working as Senior Deputy Director of General, Armoured Vehicles Factory, Avadi.

He contended that he served in various capacities in other factories. The Departmental Promotion Committee (DPC) convened in January 2012 and 2013 recommended his name along with S.K. Gupta and B.N. Singh for promotion to Appointments Committee of the Cabinet (ACC) for its final approval.

Taking a cue from this some Ministries/State Governments have adopted the provision of self-certification of documents like marksheet, birth certificate etc. by the applicants/stakeholders instead of asking for an attested copy of the documents by a Gazetted Officer or filing of affidavits. Under the self attestation method, the original documents are required,to be produced at the final stage.

. 1. Definitions. - In these rules, unless the context otherwise requires -

(a) "clerkage" means a charge levied by a railway administration for the clerical work rendered by it in the refund of fares;

(b) "destination station" means the station for which the ticket has been issued;

(c) "RAC ticket" means a ticket on which a seat has been reserved against requisition for a berth and a berth may be subsequently provided against cancellation, if any;

(d) "fare" includes basic fare, supplementary charge on superfast trains and reservation fee;

(e) "reserved ticket" means a journey ticket on which a berth or seat has been reserved;

(f) "reservation fee" means the charge, in addition to the fare, levied by the Railway administration for the reservation of a berth or seat;

He is soley engaged himself against the employees and harassing them without any reason. We have, therefore, requested your good offices to intervene and to issue necessary orders to restrain the Dr. Stalin from the unwanted activities mentioned therein and requested that the said Director be transferred to any other place to save the employees from unwarranted harassment and also to save the work culture of the Bihar GDC. No plan to increase central govt employees’ retirement age

New Delhi: Central government employees are in for a disappointment as the Centre is at present not considering any move to raise the retirement age to 62 years.

A senior official in the Ministry of Personnel, Public Grievances and Pensions, which acts as nodal department for personnel matters, said there was no such proposal to increase the age for superannuation of government employees.

"There is no proposal to increase the retirement age to 62 from 60 years. The Ministry is not working on any such proposal," the official said.


Recent media reports claimed that the Ministry has written to Prime Minister's Office for raising the retirement age and sought the Union Cabinet's nod for the purpose.

There are about 50 lakh central government employees working in various departments across the country.

The revolution in Information Technology has made it possible to overcome it to a greater extent. So far, in Central Pension Accounting Office Special Seal Authorities authorizing the banks for making payments of pensions have been generated after feeding the relevant data manually based on special seal authorities received from different Pay & Accounts Officers. On the basis of this feeding data-base of pensioners is updated in Central Pension Accounting Office.

Subject:- Implementation of Court Order dated 13.4.12, passed by the Hon'ble Delhi High Court in WP(C) No. 2092/2012.
It has been observed that there are many instances of a tender being rejected or tender documents not being issued and when the party enquires reasons, the same are not- communicated, leading to unnecessary litigation. In such cases the first round of litigation is to find out the reasons and the second round is to challenge the reasons.

2. In this context, the Hon'ble Delhi High Court, in its Final Order in WP(C) No. 2092/2012, has directed that a communication be circulated to all Government Departments to disclose reasons in such cases where enquiries are made by a contracting party, so as to avoid unnecessary litigation.

The undersigned is directed to refer to this Directorate' O.M of even number dated 6th December 2012 notifying the revised rates of damages to he chargeable from unauthorized occupants of General Pool Residential Accommodation (GPRA) from 1st January 2013. The revised rates were different for Central and Non-Central localities as well as for higher and lower types at the same station. It was also noticed that for some categories, the revised rates were very high, in some cases, even more than the basic pay of the eligible officers. The rates revised vide above said OM have been reviewed on receipt of feed-back from the allottees and it is felt that the concept of Central/Non-Central area at the same station is discriminatory and should be done away with.

While remitting the funds electronically to Axis Bank, the accredited banks shall still be required to mention the 26 character string 'PAOFIN <7 digit PAO registration number> <13 digit transaction id>s in the 7002 field for NEFT and 7495 field for RTGS as per the current process. The government is planning to extend the retirement age of all central government employees by two years — from the current 60 to 62 years. Sources said that an in-principle decision has been taken in this regard and the department of personnel and training (DoPT) has begun the work to implement the same. A formal announcement to this effect is expected this year itself.

The last time the government extended the retirement age of central government employees was in 1998. It was also a two-year extension from 58. This was preceded by the implementation of the 5th Pay Commission, which had put severe strain on government’s finances. Subsequently, all state governments followed the Centre’s policy by extending the retirement age by two years. Public sector undertakings followed suit too.

The decision to extend the retirement age is well-timed both politically and economically.

The UPA government reckons the move would be a masterstroke. At a time when it is buffeted by several corruption cases, it is felt that the extension of the retirement age will go down well with the middle classes. Economically also, the move makes sense because by deferring payment of lump sum retirement benefits for a large number of employees by two years, the government would be able to manage its finances better.

Subject: Retention of General Pool Residential Accommodation under SR 317-B-11 and SR 317-B-22 on retirement/transfer/ death of an allottee posted to a non-family station in India.
As per the extant provisions, in the event of retirement/transfer/ death of an allottee, the allottee or his/ her family is permitted to retain Government accommodation on payment of normal licence fee for the period permissible under the provisions of SR 317-B-11 and a further retention is also allowed on payment of prescribed. licence fee for the periods permissible under the provisions of SR 317-B-22 provided the accommodation is required for bona-fide use of the allottee or his/her family. However, the extended period of retention under SR 317-B-22 is not allowed in the event of death of an allottee in cases where the deceased allottee or his/her dependent family members own a house at the last place of posting.

1.      Ex-gratia Payment to SRPF / CPF beneficiaries who had voluntarily retired or medically invalidated. The enabling orders are to be issued shortly.

The Union Government is seriously considering raising the retirement age to 62 for Central Government employees. Obviously, if the Congress announces this before the Lok Sabha polls, it could expect a sizeable vote share. North Block, which houses the Union Ministry of Finance would be more than happy to have 62 years as the retirement age because for next two years the pension funds can accumulate. The UPA2 also wants to put the next government in fiscal tight spot, or what is called the War Room effect of the AICC.

            The undersigned is directed to invite attention to this Department's office memorandum No. 36012/22/93-Estt. (SCT) dated 8th September, 1993 which, inter-alia, provided that sons and daughters of persons having gross annual income of Rs. 1 lakh or above for a period of three consecutive years would fall within the creamy layer and would not be entitled to get the benefit of reservation available to the Other Backward Classes. The aforesaid limit of income for determining the creamy layer status was .subsequently raised to Rs. 2.5 lakh and Rs. 4.5 lakh and accordingly the expression "Rs. 1 lakh" under Category-VI of Schedule to OM dated 8th September, 1993 was revised to "Rs. 2.5 lakh" and to "Rs. 4.5 lakh" vide this Department's OMs No. 36033/3/2004-Estt. Subject: Empanelment of private hospitals (including dental clinics) and diagnostic centres under CGHS , Delhi & NCR
         In continuation of this Ministry's Office Memorandum of even no. dated 30.4.2013 on the above mentioned subject, the undersigned is directed to convey that in addition to the list of the hospitals (including dental clinics), diagnostic laboratories and Imaging Centres already empanelled, the hospitals (including dental clinics), diagnostic laboratories and Imaging Centres as per the list attached have also been empanelled under the continuous empanelment scheme under CGHS in Delhi & NCR. The newly empanelled hospitals (including dental clinics), diagnostic laboratories and Imaging Centres may be treated as included in the existing list with same terms and conditions as has been indicated in the Office Memorandum dated 30.4.2013.

1. Which rules Govern Pension?
Central Civil Services (Pension) Rules,1972.
2. Who is the Pension Sanctioning Authority?
The Head of Office in the Ministry/Department/Office where a Government servant last served is the pension sanctioning authority.
3. What should a Government servant do to claim his pension?
The Head of Office is required to undertake the work of preparation of pension papers in Form No. 7 of Pension Rules two years before the date on which a Government servant is due to retire on superannuation. Eight months prior to the retirement date, a Government servant is required to furnish certain information (e.g. joint photo with spouse, family details, name of the branch of the authorised bank through which he desires to draw his pension etc.) to his Head of Office in the prescribed Form No. 5. After complying with the requirements of CCS Pension Rules 59 & 60, the Head of Office has to forward to the Pay & Accounts Officer Form 5 and Form 7 duly completed with a covering letter in Form 8 alongwith service book of the Government servant duly completed up-to-date and any other documents relied upon for the verification of service, not later than six months before the date of retirement of the Government servant.

Gratuity Pay under New Pension System

Gratuity Pay under New Pension System
Death-cum-Retirement Gratuity is paid to Central Government employees under New  Pension System (NPS) as it is paid under the old pension scheme. The monthly annuity under the New Pension System (NPS) is only a replacement of pension on retirement and family pension of death after retirement. The benefits of Death cum Retirement Gratuity (DCRG) and pension/family pension have been provisionally allowed,  vide the Office Memorandum of Department of Pension and Pensioners’ Welfare No. 38/41/06-P & PW(A) dated 5.5.2009 in respect of Central Government servants covered under NPS in cases where a Government Servant is retired on invalidation/disability and in the case of death of a Government servant in service on the same rates as are applicable under the old pension scheme Central Civil Service (Pension) Rules, 1972. The retirement gratuity is payable to the retiring Government servant. A minimum of 5 years’ qualifying service and eligibility to receive service gratuity/pension is essential to get this one time lump sum benefit. Retirement gratuity is calculated @ 1/4th of a month’s Basic Pay plus Dearness Allowance drawn before retirement for each completed six monthly period of qualifying service. The maximum retirement gratuity payable is 16½ times the Basic Pay, subject to a maximum of Rs. 10 lakh. If the Government Servant dies while in service, the death gratuity shall be paid to his family at rates furnished in the table below:

Subject: Empanelment of private hospitals (including dental clinics and eve care centres) and diagnostic centres under CGHS, DELHI & NCR

The undersigned is directed to invite reference to this Ministry's Office Memorandum No: S.11011/23/2009-CGHS D.II/Hospital Cell (Part IX)dated 14.02.2013, vide which the `Continuous Empanelment Scheme' for private hospitals and diagnostic centres under CGHS was revived with a view to empanel more such facilities for the CGHS beneficiaries. Accordingly, after following the due process, a list of private hospitals (including dental clinics and eye centres), diagnostic centres and imaging centres has been finalised as per the terms and conditions laid down in the O.M. referred to above as well as signing of MOA and execution of Performance Bank Guarantee by them signifying acceptance of the terms and conditions of empanelment and rates notified under CGHS in 2010 and in OM No. Misc.1002/2006/CGHS(R&H)/ CGHS (P) dated 07.02.2013.

Subject: Grant of Dearness Relief to Central Government pensioners/family pensioners — Revised rate effective from 1.1.2013.

The undersigned is directed to refer to this Department’s O.M. No. 42/13/2012-P&PW(G) dated 4th October, 2012 on the subject mentioned above and to state that the President is pleased to decide that the Dearness Relief (DR) payable to Central Government pensioners/family pensioners shall be enhanced from the existing rate of 72% to 80% w.e.f. 1st January, 2013.


2. These orders apply to (i) All Civilian Central Government Pensioners/Family Pensioners (ii) The Armed Forces Pensioners, Civilian Pensioners paid out of the Defence Service Estimates, (iii) All India Service Pensioners (iv) Railway Pensioners and (v) The Burma Civilian pensioners/family pensioners and pensioners/families of displaced Government pensioners from Pakistan, who are Indian Nationals but receiving pension on behalf of Government of Pakistan and are in receipt of ad-hoc ex-gratia allowance of Rs. 3500/- p.m. in terms of this Department’s OM No. 23/1/97-P&PW(B) dated 23.2.1998 read with this Department’s OM No. 23/3/2008-P&PW(B) dated 15.9.2008.

The undersigned is directed to invite attention to this Department's O.M of even number dated 13.09.2012 which laid down guidelines to be followed in determination of seniority of grade(s) merged in pursuance to recommendation of 6th Central Pay Commission.

2. The erstwhile Group `D' (now merged MTS Grade) having different designation as sanctioned in different Ministries/Departments had following pay scale(s):

According the press release the the All-India CPI-IW for March, 2013 rose by 1 point and pegged at 224 (two hundred and twenty four).  This one point increase showing again showing confirm 9% increase in Dearness Allowance from July, 2013 same as last months' expectation.  But this months increase in AICPIN also increased the chances for DA hike from July, 2013 to be 10%.  Therefore Expected DA from July, 2013 may be 90% .  It is also more clear from following table:-
