Following questions replied by MINISTER OF STATE IN THE MINISTRY OF FINANCE (E&FS) (SHRI NAMO NARAIN MEENA) in Lok Sabha regarding Merger of DA in Basic Pay
 
Q: (a) whether various Associations/ Organisations of Central Government employees demanded merger of 50 per cent Dearness Allowance into the basic pay of Central Government employees and pensioners;
Ans: Yes Sir
 
(b) if so, the details thereof and reaction of the Government thereto; and
Ans: A number of representations have been received from Associations/Organizations of Central Government Employees/Pensioners and individuals demanding merger of 50% of Dearness Allowance/ Dearness Relief with basic pay/pension respectively. The demand has been considered by the Government and not agreed to since the 6th Central Pay Commission has not recommended as such.
 
(c) the recommendation of the Sixth Central Pay Commission in this regard and action taken by the Government thereto?

(1) These rules may be called the Central Civil Services (Pension) Amendment Rules, 2012.

(2) Save as otherwise provided, these rules shall come into force on the date of their publication in the Official Gazette.

Sub: Revision of pension of pre-2006 pensioners - reg.

The undersigned is directed to say that in pursuance of Government's decision on the recommendations of Sixth Central Pay Commission, orders were issued for revision of pension/family pensioners vide this Department's OM No.38/37/08-P&PW(A) dated 1.9.2008, as amended from time to time.

2. It has been decided that the pension of pre-2006 pensioners as revised w.e.f. 1.1.2006 in terms of para 4.1 or para 4.2 of the aforesaid OM dated 1.9.2008, as amended from time to time, would be further stepped up to 50% of the sum of minimum of pay in the pay band and the grade pay corresponding to the pre-revised pay scale from which the pensioner had retired, as arrived at with reference to the fitment tables annexed to the Ministry of Finance, Department of Expenditure OM No.l/l/2008-IC dated 30th August, 2008. In the case of HAG and above scales, this will be 50% of the minimum of the pay in the revised pay scale arrived at with reference to the fitment tables annexed to the above-referred OM dated 30.8.2008 of Ministry of Finance, Department of Expenditure.

The undersigned is directed to state that instructions on framing / amendment of Recruitment Rules prescribe that the proposal for framing/ amendment Recruitment Rules for Groups 'A' & 'B' posts /services as approved by the Administrative Ministries/ Departments should be referred to this Department in certain format (viz Annexure I to III) and accompanied with other documents/ information, for consideration of this Department. It has been noticed that the proposals sent by the Ministry / Department are not complete in all respects and this Department has to return the proposal seeking further information/documents/clarification for considering the proposal. Further, this Department has taken a decision that proposals for framing/amendment/revision of RRs shall now be processed on-line only and after freezing the proposal by this Department, the physical file will be accepted for concurrence.

INTRODUCTION
      The instructions on the grant of casual leave and special casual leave to Central Government servants paid from Civil Estimates, on specified occasions have been issued by the Government of India from time to time, over a period of years.  A need has been felt for consolidating at one place the instructions issued from time to time and still in force on the subject of grant of casual leave and special casual leave.  Accordingly, it has been decided to bring out the salient features of the existing instructions on the subject with which the Ministry of Personnel, Public Grievances and Pensions are now concerned in the form of a Brochure indicating the general principles relating to the grant of casual leave and special casual leave and the special features relating to grant of special casual leave for specific purposes/occasions.  The authority for the various provisions indicated in the different chapters of the Brochure has also been indicated at the end of every para so that the originals could be referred to, whenever necessary.
2.1       Casual leave is not a recognized form of leave.  The Government servant on casual leave is not treated as absent from duty and his pay is not intermitted.  Casual leave must not, however, be given so as to cause evasion of the rules regarding:-

(i)

Date of reckoning allowances

(ii)

Charges of office

(iii)

Commencement and end of leave.

(iv) 

Return to duty
Or so as to extend the term of earned or other leave beyond the time admissibility by rule.

CHAPTER I
Preliminary
1.Short title and commencement
(1)These rules may be called the Central Civil Services (Leave) Rules, 1972.
(2)They shall come into force on the 1st day of June, 1972.

2.Extent of application
Save as otherwise provided in these rules, these rules shall apply to Government servants appointed to the civil services and posts in connection with the affairs of the Union, but shall not apply to-

(a)Railway servants;
(b)persons in casual or daily-rated or part-time employment;
(c)persons paid from contingencies;
(d)workmen employed in industrial establishments;
(e)persons employed in work-charged establishments;
(f)members of the All India Services;
(g)persons locally recruited for service in Diplomatic, Consular or other Indian establishments in foreign countries;
(h)persons employed on contract except when the contract provides otherwise;
(i)persons in respect of whom special provisions have been made by or under the provisions of the Constitution or any other law for the time being in force;
(j)persons governed, for purposes of leave, by the Fundamental Rules or the Civil Service Regulations;
(k)persons serving under a Central Government Department, on deputation from a State Government or any other source, for a limited duration.

Based on the recommendations of the Committee on Prevention of Corruption headed by late Shri K. Santhanam, the Conduct Rules for Government servants were revised with a view to maintaining integrity in public Services and the Central Civil Services (Conduct) Rules, 1964 were notified laying down the Code of Conduct for Central Government employees. A bilingual edition of the Brochure on Central Civil Services (Conduct) Rules, 1964 was published in 1986 and thereafter no further edition has been brought out. In the meantime several provisions of the rules have been amended and a number of clarifications have been issued. Therefore, it has been decided to bring out an up-to-date edition.
The Brochure is, however, intended to serve only as a guide and in so far as the actual application of the Government orders mentioned under various Rules are concerned, the relevant O.M. may be consulted.
Suggestions for improvement and rectification of errors and omissions, if any, are always welcome.

Merger of SOI with Natmo: Rosolution adopted at Kolkata

Resolution adopted at the emergent extraordinary general meeting of the Ministerial Staff Association, Survey of India, Kolkata branch held in presence of six (6) Sister Organizations on Friday, the 21st December, 2012 at the ground-floor (portico) of No. 13, Wood Street premises, Kolkata — 700016 with Shri A.K. Pradhan, Hony. Secretary of Draughtsmen's (Cartographic) Association, Kolkata Branch & Jt. Secy. Gent. of the CHQs in the chair.
 
This emergent extraordinary general meeting of workers, employees and officials of Survey of India, Kolkata notes with a degree of concern that the Ministry /Deptt. Of Science & Technology, Govt. Of India in general and the Hon'ble Secretary. Dr. T. Ramasami in particular have been desperately and quite one- sidedly stepping ahead towards his planned Merger of SOI with NATMO and converting the new shape or form to be emerged out of unilaterally-proposed merger/amalgamatioii in a center of excellence in the so-called name of Re-designing & Neo­Modernization. The meeting in one voice strongly objects to and vehemently protests against such completely one-sided move on part of the Secretariat Supremo who happens to be a person since retired in 2009 but still remaining under third extension period to expire on 31st March, 2013 which is not only unconstitutional and unethical but illegal too obviously challengeable in the Court of Law.
 
2. This meeting takes a serious note to the effect that prior to his moving ahead towards 'Merger & Autonomous Body'neither the Hon'ble Secretary himself nor the Surveyor General of India had felt any least necessity to either consult the recognized Staff sides or take duly- functioning Staff Sides into confidence thereby utterly violating the mandatory Guidelines issued by the Hon'ble Cabinet Secretary to the Govt. of India to all Ministries/Departments vide No. 03/03/2001- JCM (pt.) dated 21-05-2002 for consultation with Staff Sides before taking Administrative decisions on important policy matters.

Charter of Demands for two Days’ Strike by Confederation

The Charter of Demands for the Two Days Strike contains two Parts. The First Part viz., the Part-I contains common issues of Indian Working Class and the Part-II contains the specific issues of Central Government Employees on which we have conducted the recent token strike on 12.12.12. Both Part-I and Part-II are reproduced below:

  1. Take concrete measures to contain Price rise.
  2. Take concrete measures for linkage of employement protection with the concession / incentive package offered to the entrepreneurs.
  3. Ensure strict enforcement of all basic labour laws without any exception or exemption and stringent punitive measures for violation of labour laws.
  4. Universal social security cover for the unorganised sector workers without any restriction and creation of a National Social Security Fund with adequate resources in line with the recommendation of NCEUS and Parliamentary Standing Committee on Labour.
  5. Stoppage of disinvestment in Central and State PSUs.

  7. Amendment of Minimum Wages Act to ensure universal coverage irrespective of the schedules and fixation of statutory minimum wage at not less than Rs.10,000/-.
  8. Remove all ceilings on payment and eligibility of Bonus, Provident Fund; Increase the quantum of gratuity.
  9. Assured statutory Pension for all.
  10. Ensure Compulsory registration of trade unions within a period of 45 days and immediate ratification of the ILO Conventions Nos.87 and 98.

Sub:- Action against Government servants who get appointment on the basis of false SC/ST/OBC certificates.

The undersigned is directed to invite reference to this Department's OM No.11012/7/91-Estt.(A) dated 19.5.1993 which provides as under:-

"Wherever it is found that a Government servant, who was not qualified or eligible in terms of the recruitment rules etc., for initial recruitment in service or had furnished false information or produced a false certificate in order to secure appointment, he should not be retained in service. If, he is probationer or a temporary Government servant, he should be discharged or his services should be terminated. If he has become a permanent Government servant, an inquiry as prescribed in Rule 14 of CCS(CCA) Rules, 1965 may be held and if the charges are proved, the Government servant should be removed or dismissed from service. In no circumstances should any penalty be imposed".

The undersigned is directed to state that the Government has decided to allow continuance of family pension to mentally/physically disabled children who drew, are drawing or may draw family pension even after their marriage. Further, the Government has also decided to allow two family pensions where the pensioner drew, is drawing or may draw two pensions for military and/or civil employments.

2. In order to implement these decisions, Explanations 1 and 3 after sub-rule 6 of Rule 54 of the Central Civil Services (Pension) Rules, 1972 have been suitably amended and sub- rules 13-A and 13-B have been omitted. A copy of Gazette notification, G.S.R. No. 938 (E), dated 27th December, 2012, giving effect to these amendments is enclosed.

3. For the sake of clarity, the old and new explanations 1 and 3 are reproduced as under highlighting the changes made therein:

The undersigned is directed to refer to the Office Memorandum of even no. dated 1st January, 2013 on the above subject and to further lay down the procedure for getting the diagnostic tests investigations carried out at the CGHS empanelled private hospitals/diagnostic laboratories / imaging centres on a valid prescription issued by a CCIFIS Medical Officer / Government Specialist, without a referral / permission letter from the Department concerned or CMO-in-charge of CGHS Wellness Centre, as the case may be.
 
2. The CGHS empanelled private hospitals / diagnostic laboratories / imaging centres shall perform the investigations / diagnostic tests as prescribed by the CGHS Medical Officer / Government Specialist on cashless basis to the COFIS pensioner beneficiaries, ex-MPs, freedom fighters and other eligible categories of CGHS beneficiaries, who are presently eligible for credit facility, at CGHS approved rates, only in respect of the tests / investigations for which CGHS rates are available.

Sub: Central Government Employees Group insurance Scheme-1980 - Tables of Benefits for the savings fund for the period from 01.01.2013 to 31.12.2013.

The undersigned in directed to refer to this Ministry's O.M. No.7 (1)/EV/2012 dated 9th May, 2012 forwarding therewith Tables of Benefit under CGEGIS for the year 2012. New Tables of Benefits for the savings fund of the Scheme based on a subscription of Rs.10 per month from 1.1.1982 to 31.12.1989 and Rs.15 per month we.f. 1.1.1990 onwards have been prepared for the year 2013 and a copy of the table is enclosed.  Another table of Benefits for the savings fund based on a subscription of Rs.10 per month for those employees who had opted out of the revised rates of subscription w.e.f. 1.1.1990 have also been drawn up for the year 2013 and a copy of that table is also enclosed. The amounts in the Tables have been worked out on the basis of interest @10% per annum (compounded quarterly) for the period from 1.1.1982 to 31.12.1982 11% per annum (compounded quarterly) w.e.f. 1.1.1983 to 31.12.1986, 12% per annum (compounded quarterly) w.e.f. 1.1.1987 to 31.12.2000, 11% per annum (compounded quarterly) w.e.f. 1.1.2001 to 31.12.2001, 9.5% per annum (compounded quarterly) w.e.f. 1.1.2002 to 31.1.2002, 9.0% per annum (compounded quarterly) 1.1.2003 to 31.12.2003, 8% per annum (compounded quarterly) w.e.f. 1.1.2004 to 30.11.2011, 8.6% per annum (compounded quarterly) w.e.f. 1.12.2011 to 31.03.2012 and 8.8% per annum (compounded quarterly) w.e.f. 1.04.2012 onwards. The mortality rate under the Scheme has been taken as 3.75 per thousand per annum up to 31.12.1987 and 3.60 per thousand per annum thereafter in both the cases. While calculating the amount it has been assumed that the subscription has been recovered or will be recovered from the salary of the month in which a member ceases to be in service failing which it should be deducted from accumulated amounts payable.

GS.R. 938(E).—In exercise of the powers conferred by the proviso to article 309 and clause (5) of article 148 of the Constitution and after consultation with the Comptroller and Auditor General of India in relation to persons serving in the Indian Audit and Accounts Department, the President herby makes the following rules further to amend the Central Civil Services (Pension) Rules, 1972, namely:-
1. (1) These rules may be called the Central Civil Services (Pension) Second Amendment Rules, 2012.
(2) These rules shall come into force on the date of their publication in the Official Gazette.
2. In the Central Civil Services (Pension) Rules, 1972, in Rule 54,
(a) in sub-rule (6),-
(i) in Explanation 1, for the words "daughter shall", the words "daughter, except a disabled son or daughter," shall be substituted;
(ii) in Explanation 3, for the words "her re-marriage or parents", the words "her re-marriage or by the disabled son or daughter or by parents," shall be substituted;
(b) sub-rule 13-A shall be omitted;
(c) sub-rule 13-B shall be omitted.

Subject: Extension of time limit for filing ITR-V forms for A.Y. 2010-11, A.Y. 2011-12 and A.Y. 2012-13

In exercise of its powers under clause (ii) of Para 14 read with clause (7) of Para 4 of the 'Centralized Processing of Returns Scheme, 2011', issued vide CBDT Notification No, SO 16(E) dated 4.1.2012, the Director General of Income Tax (System) hereby extends the time limit for filing ITR-V forms relating to Income Tax Returns filed electronically (without digital signature Certificate) for A.Y. 2010-11 [filed during F.Y.2011-12] and for ITRs of A.Y. 2011-12 [filed on or after 1.4.2011] till 28th February, 2013. In respect of returns filed for A.Y. 2012-13 for which ITR-V forms are yet to be received at CPC and time of 120 days has also elapsed, time limit for filing of ITR-V is extended upto 31st March, 2013 or 120 days from the date of uploading of the electronic return data, whichever is later.

 

This direction is issued to mitigate the hardship dnd grievance of the tax payers who have been prevented by reasonable causes to file the ITR-V in time.

Railway Minister Announces increase in Rail Passenger Fares

           Ministry of Railways has decided to increase the passenger fares  with effective from the midnight of 21st January 2013 and 22nd January 2013 (i.e. w.e.f. 0000 hours of 22-1-2013). This decision was announced today i.e. on 9th January 2013, by Minister of Railways Shri Pawan Kumar Bansal at a Press Conference held in Rail Bhawan.  Minister of State for Railways Shri. Kotla Jaya Surya Prakash Reddy and Railway Board Members were also present.

            The fare increase, class-wise, is as per the following table:

Moreover, it has also been decided
(i)    do away with the present practice of levying Development Charge on passenger tickets, and
(ii)   have all chargeable fares in multiples of Rs. 5/-.
         
            Elaborating the rational for fare hike,  the Railway Minister,  Shri Pawan Kumar Bansal said that  basic fares had not been revised upwards in the  last ten years (except for the increase implemented w.e.f. 01-04-12 in respect of only First Class @ 10 paise per km, AC 2Tier @ 15 paise per km and AC First / Executive Class @ 30 paise per km).   He pointed out that Losses in passenger segment which were Rs.6159 Cr in 2004-05 had risen to Rs.19964 Cr in 2010-11 (18% per annum) and  is expected to increase to Rs.25000 Cr in 2012-13.
            Shri Bansal informed that Railway’s Input costs have increased by 10.6% per annum between 2004-05 and 2010-11, whereas fares stagnated or were reduced in Lower Classes aggravating passenger losses.  He emphasized that cross subsidy through freight business is  no more viable in view of fast evolving competition from other modes.  Referring to the 2012-13 Railway Budget,  Shri Bansal said that across-the-board fare hike proposal placed in 2012-13 Railway Budget in Parliament was finally approved only for First, 2nd AC and First AC/Executive Classes, which together constitute only about 0.3 % of total passengers and about 10% of total earnings from passenger segment.  The Railway Minister pointed out that as a consequence Internal resource generation was  seriously impacted, resulting in scaling down of Annual Plan size, which has now been limited to Rs. 51,000 crore in 2012-13 as against  Rs. 61,000 crore that was originally targeted.  Similarly, Fund balances became negative in 2011-12, adversely affecting essential replacement /renewal of assets, operation and maintenance activities and critical safety & passenger amenity works.  The Railway Minister emphasized that it was in view of these factors, that increasing passenger fares had became unavoidable. It was also necessary to do so in the overall interests of this critical infrastructure as well  as its users on a sustainable basis.

Subject: Sponsoring of names of officers for deputation —

 

The undersigned is directed to state that this Department is receiving proposals for waiver of mandatory cooling off period from various Ministries/Departments/PSUs, in respect of officers, who have been sponsored for selection on deputation. As per O.M. No.6/8/2009-Estt.(Pay-II) dated 17/6/2010, there shall be a mandatory "cooling off" period of three years after every period of deputation/foreign service up to Joint Secretary level posts and one year for Additional Secretary level posts. In view of this provision, the Ministry of Railways etc. are advised not to sponsor name of any such officer who is not likely to complete the mandatory cooling off period by the time the officer is likely to be selected. Further, while sponsoring the name of any such officer who has not completed the mandatory cooling off period, they may inform the borrowing department that the officer will be relieved only after he/she completes the mandatory "cooling off" period.

 

2. All the Ministries/Departments may please note that the proposals for relaxation of the provision for 'cooling off' period would be considered only in exceptional cases. Such proposals may be referred to this Department in advance with full justification, after obtaining the approval of Minister-in-charge of the cadre authority of the officer.

 

3. It may also be noted that under no circumstances should any officer be relieved in anticipation of relaxation by this Department.

Subject:—Fixation of pay on promotion to a post carrying higher duties and responsibilities but carrying the same grade pay.
 
The undersigned is directed to invite an attention to the provisions contained in Rule 13 of the CCS(RP) Rules, 2008, which provides for the method of fixation of pay on promotion on or after 1.1.2006 in case. inter-alia, of promotion from one grade pay to another. The Rule provides for fixation of pay by way of addition of one increment equal to 3% of the sum of the pay in the pay band and the existing grade pay (rounded off to the next multiple of 10)to the existing pay in the pay band and then fixing the pay in the promotional post as per the procedure prescribed therein.

SHRI KABINDRA PURKAYASTHA (SILCHAR): An attempt has been started to shift the office of TMMz GDC Silchar to Shillong depriving not only the employees of the said office but also the people of Barak Valley, Manipur, Mizoram and Tripura, the area covered by this office.

This office has been performing it duties to its best and rendering necessary services to the Government and people.

I as the Member of Parliament from Silchar strongly demand that the TMMz GDC office in no case should be shifted elsewhere and Silchar office in all cases should be retained.

In view of this, the CPIO is hereby directed to supply copies of ACRs to the appellant for the requested period on payment of requisite fee.

Subject: Central Civil Services (Revised Pay) Rules, 2008 - the re-exercise of option under Rule 6 of the Central Services (Revised Pay) Rules, 2008 in case of employees covered under the OM dated 19.3.2012.

The undersigned is directed to invite a reference to Rules 5 & 6 of the CCS(RP) Rules, 2008, as per which a Central Government employee had an option to elect to come over to the revised pay structure either from 1.1.2006 or from the date of his next increment or from the date of promotion, upgradation of pay scales. Such an option was to be exercised within 3 months from the date of publication of CCS (RP) Rules, 2008. The rule also provides that the option once exercised shall be final.

2. This Ministry issued instructions vide this Departments OM No.10/2/2011-E-IIIA dated 19.3.2012, providing that those Central Government employees who were due to get their annual increment between February, 2006 to June, 2006 may be granted one increment on 1.1.2006 in the pie-revised pay scale as a one time measure and, thereafter, they will get the next increment in the Revised Pay structure on 1.7.2006 as per Rule 10 of the CCS (RP) Rules 2008.
