Consumer Price Index Numbers for Industrial Workers (CPI-IW) February 2013

According to a press release issued today by the Labour Bureau, Ministry of Labour & Employment the All-India CPI-IW for February, 2013 rose by 2 points and pegged at 223 (two hundred and twentythree). On 1-month percentage change, it increased by 0.90 per cent between January and February compared with 0.51 per cent between the same two months a year ago.

The largest upward contribution to the change in current index came from Food group which increased by 1.28 per cent, contributing 1.40 percentage points to the total change. This was followed by Miscellaneous and Fuel & Light groups with 0.62 and 0.80 per cent increase respectively contributing 0.27 and 0.11 percentage points to the change. At item level, largest upward pressure came from Rice, Wheat & Wheat Atta, Fish Fresh, Goat Meat, Poultry (Chicken), Milk, Onion, Tea (Readymade), Electricity Charges, Rail Fare, Petrol, etc. However, this was compensated by Root Vegetables and Sugar, putting downward pressure on the index.

The undersigned is directed to say that various references are being received from Ministries/Departments seeking advice/post facto regularisation of unauthorised absence. It has been observed that due seriousness is not being accorded by the administrative authorities to the various rule provisions, inter alia under the CCS(Leave) Rules, 1972, for taking immediate and appropriate action against Government servants staying away from duty without prior sanction of leave or overstaying the periods of sanctioned leave. It is reiterated that such absence is unauthorised and warrants prompt and stringent action as per rules. It has been observed that concerned administrative authorities do not follow the prescribed procedure for dealing with such unauthorised absence.

As per OM date 2.9.2008 CEA is admissible for two school going children does it mean any two school going children? No. Reimbursement of CEA is not permissible for third child even if reimbursement has not been claimed in respect of first and/or second child. However, as per OM No.12011/03/2008- Estt.(AL) dated 11.11.2008, the Children Education Allowance would be admissible for more than two children where as a result of the second child birth results in birth of twins or multiple children. Further, reimbursement of CEA for the 3rd child is also admissible in case of failure of sterilization operation. Such reimbursement is admissible only for the first child birth after failure of sterilization operation. This point was further clarified vide O.M. No.12011/16/2009-Allowance) dated 13.11.2009

Web Based Pensioner Portal to Facilitate Grievance Redressal of Pensioners, 
17 Lakh Hits Received on the Portal

The Department of Pension & Pensioners' Welfare has developed a web-based 'Pensioners' Portal', under the National e-Governance Plan for dissemination of pension related information as well as registration of pensioners' grievances online. Addressing the media during the National Editors Conference in the Capital, Mr. V.Narayanasamy, Minister of State in the Ministry of Personnel, Public Grievances and Pension and Minister of State in the Prime Minister’s Office stated that welfare of pensioners and their families is of utmost concern for the Government. The department has on date received 56836 pension grievances and Redressed 38822 cases. More than 17 lakh hits have been received on the pensioner portal.

The minister stated that welfare of the pensioners and their families was a top priority for the Government. Mr. Narayanasamy highlighted the steps taken by the government for pensioner’s welfare:

a) Enhancement of minimum pension/family pension from Rs.1275/- to Rs. 3500/- per month (Post VIthCPC);

Sir,
1   I am directed to refer to GOI, MoD letter No.12647/Q Mov C/2610/D(Mov)/98 dated 11 Sep 98 as amended vide corrigendum No.B/33931/AG/PS-2(b)/3343/D(Mov)/99 dated 10 Dec 99 and GOI, MoD letter No.12647/LTC/Mov C/2970/D(Mov)/08 dated 17 Dec 2008 which authorise encashment of annual leave up to 10 days along with LTC to the extent of total 60 days in a career span cover incidental expenses incurred on travel by service personnel.

2    Since the Govt orders do not specify the time frame to be maintained while disbursing advance payment of leave encashment with LTC, a clarification was sought by CGDA from DoPT.

3.   Now DoPT vide their OM No.14028/2/2012-Estt-Estt.(L) dated 26 Jun 12 (copy enclosed) have clarified that the benefit of leave encashment on LTC may be allowed 60 days before proposed date of outward journey.

Subject — Electronic Indian Postal Order — launching of.
On the initiative of Department of Personnel and Training, Department of Posts has launched a service called "eIPO" (Electronic Indian Postal Order) w.e.f. 22/03/2013. This is a facility to purchase an Indian Postal Order electronically by paying a fee on-line through e-Post Office Portal i.e. http://www.epostoffice.gov.in . It can also be accessed through India Post website www.indiapost.gov.in . As per RTI Rules, 2012, fees may be paid by electronic means, if facility for receiving fees through electronic means is available with the public authority.

2. At present, this facility is provided only for Indian Citizens abroad across the globe to facilitate them to seek information from the Central Public Information Officers (CPIOs) under the RTI Act, 2005. Debit and Credit cards can be used to purchase eIPO.

Procurement of Medicines Under CGHS

Conventional budgeting system is adopted for anticipating demand and planning procurement of medicines and stores for different systems of medicine under CGHS. Demand is ascertained on the basis of past experience of consumption of different medicines and source of supply is selected as per predetermined policy which inter alia includes direct procurement from manufacturers through a tender process. Proprietary medicines are procured from manufacturer /suppliers under rate contracts. Allopathic medicines are procured through Medical Stores Organization (MSO) and Medical Stores Depot (MSD), CGHS. Medicines are also procured through Authorized Local Chemists in case of non-availability of prescribed medicines in CGHS stores.

For procurement of medicines under other systems of medicines similar system is followed. However, bulk purchases of Ayurvedic and Unani medicines are made from Indian Medicines Pharmaceutical Corporation Limited (IMPCL), a wholly owned Government of India undertaking under the Department of AYUSH, at the rates determined by the Department of Expenditure. Homeopathic medicines are also procured through tender process and Local Chemists.

The previous note of the former JS(Per), as seen by the FM, relating to the two recommendations of the National Anomaly Committee (NAC) pertaining to (i) grant of minimum entry pay applicable to DRs in a grade in case of promotees in that grade and (ii) invocation of Rule 13 of the CCS(RP) Rules, 2008 in case of promotion from a grade to another grade involving assumption of higher functions but carrying the same Grade Pay, may kindly be glanced thorough.

2. The matter was discussed by the incumbent JS(Per) with the FS and the FM.

3. Subsequent to, and in the light of, the discussions JS(Per) had with the FS and the FM, the matter was further discussed by the undersigned with JS(Per), especially in regard to the first point relating to grant of minimum entry pay applicable to DRs in case of promotees.

Text of Union Minister Ajay Maken’s Letter to PM regarding Seventh Pay Commission

It is with a sense of pride that I seek to underline that about 3,2 million Central Government Employee and an equal number of pensioners inducting service personnel, hold you in high esteem and think of you as one amongst them. They look up to you as a leader who would not only empathize with their concerns but ensure deliverance as well. It was you who had constituted the Sixth Central Pay Commission (CPC) in 2005 which should have been set up in 2003 by the NDA Government.

2) Central Government Employee who are inducted in Government through a process of rigorous screening and testing as also stringent evaluation of a job performance are supposed to be the brightest. With globalisation and multi-national corporation coming into the country, we have at hand a two fold challenge:

(a) do have a personnel pool with high acumen to deal with these MNCs,
(b) simultaneously a dress the challenge of high attrition on which in itself is a result of MNCs having come in. 

In order to attract as also retain the brightest minds in Government employment it is but necessary that Central Pay Commission are set up regularly to look into and evaluate their pay structures and submit recommendations.

At present DA is getting ready to touch 80% level. We can expect that it will reach to 100% level near future.

Dearness Allowance Vs Price Rise
The central government employee’s confederation opined that The Dearness allowance which the cg employees are receiving now is not enough to meet the price rise of essential commodities.
The retail price of those commodities which go into making of minimum wage have risen by about 160% between 1.1.2006 to 2011 in comparison to D.A. compensation, which on the date had been just 51%

The effect of 50% Dearness allowance on our Pay
The sixth pay commission recommended that Whenever the DA reaches 50% level , Some allowances have to be increased by 25 % . Where as in Fifth CPC , it had been recommended when the DA reaches 50 % it should be merged with Basic Pay. It has been implemented with effect from 2004. And the fifth cpc also recommended that the Pay and Allowance should be revised after every five years. But it was not accepted by the Government.
The objectives of increasing Allowances by 25% as per the 6 CPC or merging DA with Basic pay as in the case of 5CPC, when ever DA reaches 50%, is to make the central government employees to balance the financial burden caused by Price Rise through increasing their pay package.

Sub:- Revision of provisional pension sanctioned under Rule 69 of the CCS (Pension) Rules, 1972

The undersigned is directed to say that in pursuance of Government's decision on the recommendations of Sixth Pay Commission, orders for revision of pension of pre-2006 pensioners wee" 1.1.2006 have been issued on 1.9.2008.

The following categories of pensioners were entitled to provisional pension as in the pre-2006 pay-scale:

a) Employees suspended before 2006 and also retired before 1.1.2006
b) Employees suspended before 2006 but retired after 112006
c) Employees who retired before 1.1.2006 and against whom departmental/judicial proceedings were pending at the time of retirement.

Budget 2013: Will Dearness Allowance Be Exempt From Income Tax?

JAMMU: National Mazdoor Conference (NMC) is seeking exemption of Dearness Allowance from the ambit of income tax as DA is directly linked with the price index.

 

"The price escalation is directly linked with the DA of the salaried class and pensioners but it was strange that the income tax is also imposed on the increase of the salaries because of the DA," NMC president Subash Shastri said here today.

"There is no justification of imposing income tax on DA," Shastri said while addressing a rally of NMC workers.  The NMC president also asked Union Finance Minister P Chidambaram to reconsider the practice.


He also said that income tax exemption limit should be raised to Rs five lakh from existing Rs two lakh.  Shastri, meanwhile, added that provision with regard to 20 per cent interim relief to the central and state government employees and pensioners, merger of 50 per cent of DA into basic pay/pension and enhancement of monthly wages of dailywagers to Rs 10,000 should be made during the current Budget session.

Ajay Maken backs cry for seventh pay panel
NEW DELHI: With a little over a year to go before the next general election, the demand for a Seventh Pay Commission has started to gather momentum. Union housing and urban poverty alleviation minister Ajay Maken has taken the lead in endorsing the Central government employees' request for setting up of the new pay panel, citing the erosion of real wages due to high inflation since implementation of the Sixth Pay Commission's recommendations. 

In a letter addressed to Prime Minister Manmohan Singh, Maken underlined how every pay panel since the Second Pay Commission, barring the Sixth Pay Commission, were set up in the third year of the decade. "We are again in the third year of the ongoing decade and Central government employees are justifiably looking forward to the Seventh Pay Commission," he said. 

Recalling that it was under Singh that the last pay panel was set up in 2005, after the NDA government failed to do so in 2003, Maken, in the communication dated March 14, requested that a decision be "taken on priority" for constitution of the Seventh Central Pay Commission. "A notification for constitution of the 7th Central Pay Commission is the need of the bour, which is bound to have bearing upon about 20 million employees," he said. 

Maken concluded by emphasizing that setting up of the new pay panel was in "larger interest of government employees as well as the (Congress) party".

CGHS Empanelled Hospitals in Delhi NCR

Some private hospitals in Delhi NCR are no longer on the list of CGHS empanelled private hospitals. The details are as under:

1. The following hospitals have opted not to renew their empanelment with CGHS after completion of two years of empanelment. Accordingly they have been removed from CGHS panel w.e.f. 13.02.2013:
(i) Escort’s Heart Institute & Research Centre, New Delhi
(ii)Max Super Specialty Hospital, New Delhi

2. Empanelment of following two hospitals has been suspended:
(i) Max Devki Devi Heart & Vascular Institute, New Delhi (w.e.f. 13.02.2013) as the hospital stopped credit facility to eligible CGHS beneficiaries;
(ii) Bapu Nature Cure Hospital, New Delhi (w.e.f.12.09.2013) on account of deficiency in services.
In addition, the following hospitals in Delhi NCR have been removed w.e.f. 18.12.2012 from the CGHS panel for non-compliance of the terms and conditions of their empanelment with CGHS.
(i) Garg Multispecialty Dental & Research Centre, Ghaziabad
(ii) Jain Hospital, Jagriti enclave, New Delhi
(iii) Kalra Hospital, New Delhi
(iv) Orthonova Hospital, New Delhi

Income Tax Office will remain open 30th & 31st March, 2013 with additional receipt Counter

CBDT has directed that all the Income Tax Offices through out India shall remain open and the receipts counters shall also work during normal office hours on 30th and 31st of March 2013.  Special arrangements may also be made by way of opening additional receipt counters, wherever required on 30th and 31st March 2013.

Order under Section 119 (1) of the Income Tax Act, 1961.

The Financial Year 2012-13 closes on 31-3-2013. In view of holidays on 27th and 29th of March and thereafter, on 30th and 31st March, being Saturday and Sunday, it is directed that all the Income Tax Offices through out India shall remain open and the receipts counters shall also work during normal office hours on 30th and 31st of March 2013. This direction is issued for administrative convenience by the Central Board of Direct Taxes in exercise of powers conferred under section 119 of the Income Tax Act, 1961.

Special arrangements may also be made by way of opening additional receipt counters, wherever required on 30th and 31st March 2013 to facilitate filing of return of income and other related work of tax payers. These instructions may be given wide publicity.

SEVENTH PAY COMMISSION MUST BE SET UP FORTHWITH 

The recent statement of the Minister concerned in the Parliament, that the Govt does not propose to set up the seventh Pay Commission at this stage is most unjustified and frustrating for the Govt employees.
Fifth Pay Commission had recommended for a Pay Revision after every five years instead of the past practice to set it up after 10 to 13 years. But the Govt did not accept this recommendation.

The Fifth Pay Commission also recommended for Merger of DA after it crossed 50%. Govt accepted the same and belatedly implemented it from April 2004. But the Sixth Pay Commission did not favour even the Merger of DA after it crossed 50% and the Govt obvious followed suit and did not Merge the same when it crossed 50% in 1-1-2011 – in spite of the demand by all concerned.

As such, the existing Pay and Pension structure have lost all the relevance and is continuously eroding due to heavy inflation and defective system of compilation of Price Index – which itself is out dated due to the changed economic scenario and requirements of the Industrial Worker of the Country.

All this makes it essential that the Seventh Pay Commission be set up early to compensate for the erosion of real wages and to remove the serious Anomalies of Sixth CPC Report – which the Govt and the Anomalies Committee have failed to address as well as to bridge the vast gap of wages between the Government employees and those of the Corporate Sector etc. all which are having a very demoralising effect amongst the Govt employees and Pensioners.

Subject : Revision of flat rates of Licence fee for Central Govt Residential Accommodation throughout the country.

In terms of SR-324(4), the Government has decided to revise the flat rates of licence fee recoverable for the residential accommodation available in General Pool and also in Departmental Pools of Ministries & Departments of the Government of India throughout the country (except in respect of substandard/unclassified accommodation of Ministry of Defence, accommodation for service personnel of the Ministry of Defence and accommodation under the control of Ministry of Railways), as shown in the Annexure.

2. The revised rates of licence fee would be effective from 1st July, 2010. All Ministries / Departments are requested to take action to recover the revised licence fee in accordance with these orders in respect of accommodation under their control all over the country.

(a) & (b): Women are provided equal opportunity in the matter of employment under the Government. Some special facilities like maternity benefit, child care leave, child adoption leave, crèche facility for children, posting of husband and wife at the same station as far as possible, special priority in allotment of residential accommodation etc. are provided to the women employees to encourage them to join Government service. However, at present, there is no proposal to give reservation to women in services or in promotion.

PROVISIONS RELATING TO DIRECT TAXES

Introduction

The provisions of the Finance Bill, 2013 relating to direct taxes seek to amend the Income-tax Act, Wealth-tax Act and Finance (No.2) Act, 2004, inter alia, in order to provide for –
A.            Tax rates
B.            Additional Resource Mobilisation
C.            Measures to Promote Socio-economic Growth
D.            Relief and Welfare Measures
E.            Widening of Tax Base and Anti Tax Avoidance Measures
F.            Rationalisation  Measures

2.            The Finance Bill, 2013 seeks to prescribe the rates of income-tax on income liable to tax for the  assessment year 2013-14; the rates at which tax will be deductible at source during the financial year 2013-14 from interest (including interest on securities), winnings from lotteries or crossword puzzles, winnings from horse races, card games and other categories of income liable to deduction or collection of tax at source under the Income-tax Act; rates for computation of “advance tax”, deduction of income-tax from, or payment of tax on ‘Salaries’ and charging of income-tax on current incomes in certain cases for the financial year 2013-14.

Minutes of the 22nd meeting of Standing Committee of Voluntary Agencies (SCOVA) held on 19.2.2013 under the Chairmanship of Hon’ble Minister of State (PP) at Vigyan Bhawan Annexe, New Delhi

The list of participants is at Appendix – I.

2. At the outset Secretary (P&PW) welcomed Hon’ble MOS(PP), representatives of Pensioners Associations and the participating officers of various Ministries/Departments. He mentioned that SCOVA has been successful in achieving the objective for which it was started in 1986. Secretary (P&PW) added that the serving officers should be considerate to the pensioners as they will also join the ranks of pensioners after retirement. He praised the contributions made by the Pensioners as officers during their tenure in the Government and also applauded for their present contributions as Senior Citizens. Referring to the issue of revision of PPOs, he mentioned that a lot of work had been done. However, still a lot remained to be done. Efforts were on to make the procedures simple and uncomplicated.

3. Welcoming the participants, Hon’ble MOS (PP) stated that as promised last time, the SCOVA meeting was being held for the second time in a year. He mentioned that Department of P&PW is coordinating with several other Ministries/Departments to redress the grievances. The pensioner’s portal is very user friendly. CGHS still remains a contentious issue. He also referred to the problem of Ministry of Defence where pensioners data was available manually. He urged them to switch over to the computerised system of data maintenance and calculating pension to overcome the problem of delay in sanction/revision of pension.

Not considering proposal to set up 7th Pay Commission: Govt

NEW DELHI: Admitting that there have been demands for setting up of 7th Pay Commission, government said that no such proposal is under consideration for such exercise, which would have been resulted in upward revision of centre's over 85 lakh employees' and pensioners' pay scales.

"The recommendations of the previous .. 6th Central Pay Commission were given effect to from January 1, 2006. Therefore, at present no proposal to constitute the 7th Pay Commission is under consideration of the government," Minister of State for Finance Namo Narain Meena told Lok Sahba on Friday in a written reply.

Meena further said, "There have been some demands received for setting up of the 7th Central Pay Commission. In the past, there has generally been a gap of a minimum 10 years between two successive Pay Commissions.

According the information available, the central government employees had also gone for a day long token strike for their various demands including setting up of 7th Pay Commission in December last year.

At present the number of central government employees and pensioners are about 50 lakh and 35 lakh respectively.

Consumer Price Index for Industrial Workers (CPI-IW) – January, 2013

The All-India CPI-IW for January, 2013 rose by 2 points and pegged at 221 (two hundred and twenty one). On 1-month percentage change, it increased by 0.91 per cent between December and January compared with 0.51 per cent between the same two months a year ago.

The largest upward contribution to the change in current index came from Housing Group which increased by 3.53 per cent, contributing 1.28 percentage points to the total change. This was followed by Miscellaneous and Food groups with 0.74 and 0.26 per cent increase respectively contributing 0.32 and 0.28 percentage points to the change. At item level, largest upward pressure came from Rice, Wheat & Wheat Atta, Groundnut Oil, Eggs (Hen), Fish Fresh, Goat Meat, Poultry (Chicken), Onion, Tea (Readymade), Firewood, Auto Rickshaw Charges, Bus Fare, Rail Fare, etc. However, this was compensated by Arhar Dal, Potato, Tomato, Other Green Vegetables, Sugar, Electricity Charges and Flower/Flower Garlands by putting downward pressure on the index.

The year-on-year inflation measured by monthly CPI-IW stood at 11.62 per cent for January, 2013 as compated to 11.17 per cent for the previous month and 5.32 per cent during the corresponding month of the previous year. Similarly, the Food inflation stood at 14.08 per cent against 13.53 per cent of the previous month and 0.49 per cent during the corresponding month of the previous year.

At centre level, Durgapur recorded the largest increase of 18 points followed by Jharia (10 points), Godavarikhani (9 points), Goa and Surat (8 points each), and Chandigarh (6 points). Among others, 5 point rise was registered in 3 centres, 4 points in 6 centre, 3 points in 12 centres, 2 points in 13 centres and 1 point in 11 centres. On the contrary. Labac-Silchar and Mariani-Jorhat centres reported a decline of 2 points each. The indices of Jalandhar, Rourkela, Sholapur and Kolkata were also declined by 1 point each. Rest of the 21 centres’ indices remained stationary.

The indices of 39 centres are above All-India Index and other 38 centres’ indices are below national average. The index of Mysore centre was at par with all-India index.

The next index of CPI-IW for the month of February, 2013 will be released on Thursday, 28 March, 2013. The same will also be available on the office website www.labourbureau.nic.in.

Dear Comrades,
The 22nd meeting of SCOVA was held at New Delhi on 19th February, 2013. On behalf of the JCM. Staff Side, the Secretary, Com. Umraomal Purohit accompanied by Com. S.K. Vyas, President, Confederation of CGE and workers attended the meeting. The outcome of discussion at the meeting is briefly as under:-

(1) Revised PPO for pre and post 2006 retirees. As per the action taken statement circulated at the meeting, certain progress has been made. In the Postal Department, 45% of the pensioners cases have been cleared. In the Ministry of Railways, 555460 PPO have been issued. However, cases of 613123 are still to be cleared. In Telecommunication and the Ministry of Defence, the work is yet to begin, whereas all Ministries including Postal and Railways have been asked to complete the work latest by 31.3.2013. The Ministry of Telecommunication and Defence have been given time upto 30th September, 2013.

(2) Revision of Ex gratia amount to CPF retirees. The Cabinet Note has been prepared and sent to the Cabinet Sectt. Orders are expected soon.

 Another pro-rich budget

The Union Budget 2013-14 presented by the Finance Minister Shri P. Chidambaram, today in the Parliament was extremely disappointing to the common working people . No doubt they have not expected any relief from this anti people Government and especially from its Finance Minister, Shri P.Chidambaram.  However, they hoped against hope that the Government will read the discontent that is growing fast amongst the people, manifested admirably in the two day strike of the Indian Working Class on 20th and 21st.  Despite the erosion of the real value of the wages due to the high rate of inflation, the wage earners genuinely thought that they would be provided with some relief by way of an adjustment of the non taxable maximum.  While the give away to the corporate sector continued as the Finance Minister himself has noted in his budget speech in as much as the revenue foregone on direct taxes did register an increase from a lakh crore rupees to Rs. 1.13 lakh Crores in the last year he never felt the need to address the agony of the workers.
Despite the fall in the rate of growth of economy, the Finance Minister has taken pride in the fact that India continues to be one of the fast growing economy.  What type of growth he was visualizing is hard to gauge when the number of people below poverty line had been on the increase year after year.  There had been all-round increase in the prices of all essential commodities including those where the Government had a say in determining it.  The Railway Minister did not increase the fare for passenger trains for he did it before he presented the budget.  The economic growth and recovery would be a mirage so long as the purchasing power of people get depleted.  There had been substantial reduction of workforce in the organized sector due to intensified contractorisation.

Benefit under Section 80-D of the Income Tax Act for CGHS Extended to Similar Schemes of the Central Government and State Governments

The Finance Bill 2013 proposes extension of benefits under Section 80-D of the Income Tax Act to such schemes of the Central Govt and State Govts that are similar to Central Govt. Health Scheme(CGHS). Presenting the Union Budget in the Lok Sabha today, the Finance Minister Shri P.Chidambaram said that contributions made to CGHS are eligible for deduction under Section 80-D of the Income Tax Act and he is proposing to extend the same benefit to similar schemes of the Central Govt and State Govt. The Finance Minister also announced that deductions made to the National Children’s Fund will now be eligible for 100% deduction.
