       The undersigned is directed to forward herewith a copy of Gazette of India (Extraordinary) Part II, Section-3, Sub-Section (i) dated 23.4.2013, notifying the Directorate of Estates' Notification of even number dated 10.4.2013 on the subject mentioned above for information and further necessary action.

2. The amendment notified vide the aforesaid Gazette shall be applicable to all the allottees of General Pool Residential Accommodation retiring on or after 23.4.2013.

3.     It is clarified that the aforesaid amendment shall not be applicable to the allottees who have retired prior to 23.4.2013 and they will be eligible for retention of accommodation as per the rules in force prior to the aforesaid amendment.

DA from Jan-2013: Order issued by finmin


The additional dearness allowance @ 8% from 1st January 2013 for Central Government Employees was  approved by cabinet. The Finance ministry has issued order to grant additional DA from July, 2012 vide his No. 1(2)/2013-E-II(B) dated 25th April, 2013.  Text of said OM are reproduced below:

     The undersigned is directed to refer to this Ministry's Office Memorandum No. 1(8)/2012-E-II (B)  dated  28th September, 2012 on the subject mentioned above and to say that the President is pleased to decide that the Dearness Allowance payable to Central Government employees shall be enhanced from the existing rate of 72% to 80% with effect from 1st Jan, 2013.

Rajya Sabha website has uploaded the finance ministry's latest reply dated 23.04.2013 about no proposal to constitute the Seventh Central Pay Commission is at present under consideration.  In reply of unstarred question by Shri Sukhdev Singh Dhindsa "Whether Government proposes to set up the Seventh Central Pay Commission for Central Government Employees to neutralize the effects of soaring inflation" the finance ministry has submitted a reply, "The recommendations of the 6th Central Pay Commission were given effect to from 1.1.2006. Generally, there has been a gap of a minimum 10 years between two successive Pay Commissions. Subject:- Children Education Allowance — Clarification -

The undersigned is directed to refer to Department of Personnel & Training's O.M. No.12011/03/2008-Estt.(Allowance) dated 2' September, 2008, and subsequent clarifications issued from time to time on the subject and to state that various Ministries/Departments have been seeking clarifications on various aspects of the Children Education Allowance. The doubts raised are clarified as under:-

(i) Whether reimbursement of balance amount of fee paid during 1st and 2nd quarter could be paid in 3rd/4th quarter without the fee receipt for the 3rd/4th quarter? No. As it is reimbursement for the whole year, original receipts for the fee paid for the 3rd/4th quarter has to be submitted to ensure that the child has not dropped out of the school in the mid-session.
(ii) Whether a Government servant is required to give a certificate that the spouse, if earning, has not claimed CEA? Yes. The claimant Government servant is required to furnish an undertaking that reimbursement of CEA has not been claimed in respect of the child by any person other than the claimant.

As per an article "No merger of D.A. but seventh pay commission likely this year" published by reputed website for Central Government Employees [http://paycommissionupdate.blogspot.in], the setting up of seventh pay commission likely this year.  In view of the late decision on grant of dearness allowance to central government employees and pensioner for the month of January, 2013 by Govt. it is easy to accept that Govt. will not consider merger of dearness allowance in basic pay and it is hard to accept that Govt may set up the seventh pay commission in this year.  But in view of suggestions by Union Minister Vijay Maken  and trade/employee union demands Govt. may set up the 7th CPC.  It is also evident that Govt had already denied the demand of merger of DA [click here to view] as well as in last session of parliament Govt. had also submitted that no proposal of setting up of seventh pay commission [click here to view].  In view 13th Finance Commission recommendation [click here to view] "Structural shocks such as arrears arising out of Pay Commission awards should be avoided by making the pay award commence from the date on which it is accepted." and payment of arrears of One Rank One Pension [click here to view] from date of acceptance i.e. 24th Sep, 2012 not from 01.01.2006 or 01.09.2008, the early setup of seventh pay commission is necessary to avoid the loss of increased pay & allowance.  In Sixth pay commission the arrears of allowances was not given.  In other words the early setup of seventh pay commission will also increase the future financial liabilities of government.

Sub: Issuance of certificate for tax deducted at source in Form No. 16 in accordance with the provisions of section 203 of the Income-tax Act, 1961 read with the Rule 31 of the Income-tax Rules 1962 -- regarding
1. Section 203 of the Income-tax Act 1961 ("the Act") read with the Rule 31 of the Income-tax Rules 1962 ("the Rules") stipulates furnishing of certificate of tax deduction at source (TDS) by the deductor to the deductee specifying therein the prescribed particulars such as amount of TDS, valid permanent account number (PAN) of the deductee, tax deduction and collection account number (TAN) of the deductor, etc. The relevant form for such TDS certificate is Form No. 16 in case of deduction under section 192 and Form No. 16A for deduction under any other provision of Chapter XVII-B of the Act. TDS certificate in Form No. 16 is to be issued annually whereas TDS certificate in Form No. 16A is to be issued quarterly. TDS Certificate in Form No 16 as notified vide Notification No. 11/2013 dated 19.02.2013 has two parts viz Part A and Part B (Annexure). Part A contains details of tax deduction and deposit and Part B (Annexure) contains details of income.

Subject: Introduction of online reservation system in the reservation/allotment of casual hostel accommodation in the Central Government Touring Officer's Hostel/Holiday Home/Guest House at Delhi.

         With a view to provide for choices & convenience of the applicants for reservation of casual hostel accommodation in the Central Government Touring Officer's Hostel/Holiday Home/Guest House at Delhi, it has been decided to introduce automated online reservation/allotment system w.e.f. 01/05/2013.

2.     For this purpose only online applications will be accepted henceforth. Applicants will apply for reservation by filling up the required application form online. After completing the process online, the applicant will have to take a print out of his/her application and get it verified/forwarded from his/her office and send it along with payment (Demand Draft) & other allied details/documents etc., to "Online Reservation Cell, F — Block, C.R.Hostel Kasturba Gandhi Marg, New Delhi -110001" for confirmation of his/her booking request. On receipt of the filled up application with payment of room rent (Demand Draft), duly verified & forwarded by the controlling office of the applicant (in case of Retd. Government Officers attested copy of PPO), his/her booking request will be processed. Applicant can monitor the status of his/her booking request online through the website.

Dearness Allowance hiked by 8%: Zee News

New Delhi: The Union Cabinet on Thursday approved a proposal to increase dearness allowance (DA) by 8 percent to 80 percent from existing 72 percent.

The move will benefit about 50 lakh employees and 30 lakh pensioners of the central government.

The hike would be effective from January 1, 2013 and the employees and pensioners would be entitled for arrears.

Decision on hiking DA was deferred on April 2 as the Finance Minister was not present.

The government had hiked DA to 72 percent in September last year, which had come into effect from July 1, 2012.

As per the practice, the DA is merged with basic pay when it breaches the 50 percent cap. This helps employees get higher allowances as those are paid as proportion of the basic pay.

NEW DELHI: The Union Cabinet is likely to approve a proposal to increase dearness allowance (DA) of central government employees by 8% on Thursday.

The move to increase DA from 72% to 80% will benefit around 50 lakh employees and 30 lakh pensioners of the central government.

"The Union Cabinet may consider the finance ministry proposal to increase DA in its meeting scheduled for Thursday," a source said, adding the hike would be effective from January 1, 2013 and employees and pensioners would be entitled to arrears.

The government had raised DA to 72% in September last year, which had come into effect from July 1, 2012.

As per usual practice, DA is merged with basic pay when it breaches the 50% cap. This helps employees get higher allowances as those are paid as proportion of the basic pay.

Subject: Implementation of suo motu disclosure under Section 4 of RTI Act, 2005 — Issue of guidelines regarding.

Section 4(1)(b) of the RTI Act lays down the information which should be disclosed by Public Authorities on a suo motu or proactive basis. Section 4(2) and Section 4(3) prescribe the method of dissemination of this information. The purpose of suo motu disclosures under Section 4 is to place large amount of information in public domain on a proactive basis to make the functioning of the Public Authorities more transparent and also to reduce the need for filing individual RTI applications.

2. Since the promulgation of the Act in 2005, large amount of information relating to functioning of the government is being put in public domain. However, the quality and quantity of proactive disclosure is not up to the desired level. It was felt that the weak implementation of the Section 4 of the RTI Act is partly due to the fact that certain provisions of this Section have not been fully detailed and, in case of certain other provisions there is need for laying down detailed guidelines. Further there is need to set up a compliance mechanism to ensure that requirements under section 4 of the RTI Act are met.

Need for 7th CPC

The background of the demand for setting up the 7th CPC raised by the Central Government employees on the ground that the wage revision was due in January, 2011,it would be pertinent to examine the wages as a ratio to the revenue resources and revenue expenditure of the GOI in the crucial years 1960-61,1975-76, 1986-87, 1997-98 and 2006-07 the relevant years in which the 2nd, 3rd, 4th, 5th and 6th CPC recommendations were given effect to. It is not difficult to discern the declining trend over the years , which is suggestive of the erosion in the real wages of the Public servants in India.

Announcement of DA from Jan 2013: Speculation of reasons for delay – karnmk.blog
 
 
After implementation of recommendations of Sixth Pay Commission the Govt. has accepted the calculation of standard formula for calculation of future DA and in para 4.1.19 Sixth Pay commission has recommended that DA may continue to be sanctioned twice a year as on 1st January and 1st July payable with the salary of March and September.  After 6th CPC implementation order of DA from January of respective years was issued/declared as follows:-


15/3/2007- 6% – Thursday
07/3/2008 -6% – Monday
26/2/2009- 6% – Thursday
19/3/2010 – 8% – Friday
22/3/2011- 6% – Tuesday
23/3/2012 -7% – Friday

DA from January, 2013 is yet to be announced.  No any reason for delay is stated from any reliable sources and no exact reason can be constitute for it.  Now everyone to speculate the reason for delay in announcement.  The following main facts are presented to inspect the reasons:

1. Merger of DA with Basic Pay:  This is the first reason is everyone's mind.

6.2 (d) No officer should serve in any particular station, whether in a single posting or different postings, at the level of Director and above, for a total period of more than 10 years.

6.2 (e) No Officer should remain in a particular station continuously for more than 5 years.

The undersigned is directed to say that as per the extant policy of the Government, all posts are to be filled in accordance with provisions of the applicable Recruitment Rules/Service Rules. As explained in this Department's O.M. No.28036/8/87-Estt.(D) dated 30.03.1988 read with O.M. No.28036/1/2001-Estt.(D) dated 23.07.2001, promotions/ appointments on ad- hoc basis are to be resorted to only in exceptional circumstances mentioned therein, to a post which cannot be kept vacant in consideration of its functional/operational requirement. Govt. defers decision on hiking dearness allowance: ANI
New Delhi, Apr. 2 (ANI): The Congress-led UPA Government today deferred a decision on hiking dearness allowance (DA) of central government employees to 80 percent from 72 percent at present.

Information and Broadcasting Minister Manish Tewari after the Cabinet meeting chaired by Prime Minister Dr. Manmohan Singh said 'the proposal on DA has been deferred as the Finance Minister was not present'.
Finance Minister P. Chidambaram is presently on an official visit to Japan.
About 50 lakh employees and 30 lakh pensioners would have benefitted with an increase in dearness allowance. (ANI)

Union Cabinet likely to approve dearness allowance hike to 80% tomorrow

Union Cabinet is likely to approve tomorrow a proposal to increase dearness allowance (DA) to 80 per cent from existing 72 per cent benefiting about 50 lakh employees and 30 lakh pensioners of the central government.

 

The Union Cabinet may consider the finance ministry proposal to increase the DA by 8 per cent to 80 per cent in its meeting scheduled for tomorrow”, a source said.

The hike would be effective from January 1, 2013 and the employees and pensioners would be entitled for arrears, he said.

The government had hiked DA to 72 per cent in September last year, which had come into effect from July 1, 2012.

“It is good that they are increasing DA. We demand that they should merge up to 50 per cent DA with the basic pay as per the practice and set up the seventh pay commission at the earliest”, Secretary of Confederation of Central Government Employees, K K N Kutty said.

As per the practice, the DA is merged with basic pay when it breaches the 50 per cent cap. This helps employees get higher allowances as those are paid as proportion of the basic pay.
