The Principal CAT [OA 904/2012 dt. 26-11-2012], Delhi and the Punjab & Haryana High Court [CWP No. 19387 of 2011 (O&M) Date of Decision: 19.10.2011] have held that MACP is to be granted on promotional hierarchy and not on next higher Grade Pay as per the 6th Pay Commission Recommendation. The SLP filed by Union of India against the P&H decision was dismissed by the Supreme Court [CC 7467/2013].

ReplyDeleteThe verdict of Apex Court should change the policy to help for those who are suffering from grade pay hierarchy. One should not happy with the mere outcome of the verdict. We should strive hard to make DOPT (which is the nodal agency for MACP) to issue necessary guidelines to this effect.

ReplyDeleteIt is certain, DoPT will implement and bring out necessary orders for all departments.
I've sent the appeal with CAT, High Court, supreme court's order to Sri Raghavaihya, GS/NFIR, & Sri S.G.Mishra, GS/AIRF on 13.09.2013. And friends both the General Secretaries took steps immediately and wrote letter on 13 & 14.09.2013 to Railway Board for implementing the same on basis of Supreme Courts order with arrears.
ReplyDeleteWhat the finance department,6th finance commission, JCA, MACP Anomaly committee etc could not understand for last five years are made to under stand the natural justice by High Court and Supreme Court. Really there exists court in India and so we employees are saved. Thanks to Courts for upholding the justice given to the Govt. employees.

This verdict should be honoured by all Central Govt Departments and be implemeneted without waiting for the DOPT to issue orders in true spirit.

ReplyDeleteCourt orders on many such beneficial issues are still pending with concerned Department in Government of India for implementation. Therefore, the need of the hour is to give maximum publicity to the subject matter and apex court verdict through news papers and visual media so that the entire affected employees in the country would be aware the same so that they can also individuals write to DOPT for early issue of matching Govt orders for implementation of MACP on hierarchical posts. Govt would also try to procrastinate/delay the matter (especially during the present occasion as General Election is coming up during 2014) and try to pass on the buck to the successive Govt which in turn will result in further delays. We must try to get the formal Govt orders issued during the UPA Government itself.
ReplyDeleteAs per the Supreme Court Verdict, the DoPT may please take up the issue of MACP for LDC & UDC must be on Promotional hierarchy basis. I am also one of the victim of MACP on hierarchy basis, as I got 1st financial upgradation under MACP grade from Rs.1900 to 2000 (only Rs.100 benefit for 10 years of regular service in LDC Cadre which is discouraging and heartburning issue) after adapting the MACP scheme from 1.9.2008, whereas my colleagues LDCs who got CAS before 1.9.2008 are in GP of Rs.2400/-. I pray to the DoPT / Ministry of Expenditure to kindly re-issue the guidelines in light of the Supreme Court Orders for granting of MACP for LDCx & UDCs on Promotional Hierarchy not on Grade Pay Hierarchy please.
ReplyDeleteWhen the higher cadre employees and staff nurse employees only raise their demands the DOPT issues clarifications/upgradation etc. etc. immediately. But, when it is the issues of LDC/UDC, even after the order of Hon'ble Supreme Court, it is being delayed by DOPT to issue an order. Just imagine what a very strong racket is working against the LDC/UDC.

ReplyDeleteWhy the DOPT is not taking the decision to issue the common order to all Ministries even though the H'ble Supreme Court has dismissed the SLP filed by the Govt. against the H'ble Punjab and Haryana High Court order to Grant the MACP on Promotional Hierarchy. My doubt is whether the Govt. has filed any suit in this matter or why the Govt/DOPT is delaying to issue the common order. The Govt./DOPT should inform that is there any another appellate authority is in our nation after getting the order from the H'ble Supreme Court. I request all the LDC/UDC/eligible employees and those who are suffered a lot and loss of financial benefits after implementation of MACP, kindly send their representation to Prime Minister along with the copies of H'ble CAT/High Court/Supreme Court orders copies.
ReplyDeletelekin sarkar is kab tak implement karegi.is bare men employees unions kya kar rahi hai? unions ko iske liye andolan karna chahiye.sarkar supreme court ke adesh ke bad bhi adesh jari nahi kar rahi hai iske kya karan hai.hamare netaon ko iske bare men dekhna chahiye.kyonki employees unke uper bharosa karme unhe apana representative chunte hai,Do something concrete.

ReplyDeleteGreat that DOPT or any relevent authority to execute orders, does not care even for Hon'able High Court / Supreme Court Verdicts ref. MACP in Promotional Hierarchy, almost six months gone.

Why, DOPT has not issued the order till date after suprim court judgement on MACP.
ReplyDeleteAfter Supreme Court dismissed the SLP of DoPT. Delhi CAT has passed order dated 12.03.14 and High court Upheld the order of CAT Delhi in order dated 14.07.2014. Even then DoPT is not convinced.
